Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Innovations Beyond, Inc ("Company," "we," "us," or "our") governing your access to and use of the Faith Sync mobile application and related services (collectively, the "Service").

1. Eligibility

To use Faith Sync, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

If you are using the Service on behalf of an organization (such as a church), you represent that you have the authority to bind that organization to these Terms.

2. User Accounts

Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Account Security

You are responsible for safeguarding your password and for any activities or actions under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

3. Church Administrator Accounts

Church administrators who subscribe to Faith Sync on behalf of their religious organization have additional responsibilities:

• Authorization: You represent that you are authorized to act on behalf of your church or religious organization
• Member Data: You are responsible for obtaining appropriate consent from congregation members before adding their information to the Service
• Data Accuracy: You are responsible for maintaining accurate member records
• Compliance: You agree to use the Service in compliance with all applicable laws, including data protection regulations
• Content Responsibility: You are solely responsible for all announcements, events, and content you publish through the Service
• Donation Compliance: You are responsible for ensuring donation processing complies with applicable tax laws and nonprofit regulations

4. Subscriptions and Payments

Subscription Plans

Church administrators may subscribe to paid plans to access premium features. Subscription details, including pricing and features, are available on our website and during the signup process.

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as expressly stated in these Terms or required by law
• We use third-party payment processors (Stripe) to handle payments securely

Automatic Renewal

Subscriptions automatically renew unless canceled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting support.

Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice before any price increase takes effect. Continued use of the Service after a price change constitutes acceptance of the new price.

Refunds

If you cancel within the first 14 days of a new subscription, you may request a full refund. After 14 days, subscriptions are non-refundable, but you will continue to have access until the end of your billing period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others, including intellectual property rights
• Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for commercial solicitation without authorization
• Harvest or collect information about other users without consent
• Transmit viruses, malware, or other malicious code
• Use automated means to access the Service without permission

We reserve the right to suspend or terminate accounts that violate these acceptable use policies.

6. User Content

Your Content

You retain ownership of any content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, and display your User Content solely for the purpose of operating and providing the Service.

Content Standards

You are responsible for ensuring your User Content:

• Does not violate any third-party rights
• Is accurate and not misleading
• Complies with all applicable laws
• Is appropriate for a religious community context

Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful or inappropriate.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Innovations Beyond, Inc and are protected by copyright, trademark, and other intellectual property laws.

The Faith Sync name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Innovations Beyond, Inc. You may not use these marks without our prior written permission.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service.

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected

Faith Sync is a communication and management tool for religious organizations. We do not provide religious, legal, financial, or professional advice through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNOVATIONS BEYOND, INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE PAST TWELVE (12) MONTHS FOR THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Innovations Beyond, Inc and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any User Content you submit through the Service

12. Termination

Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature (if available). Upon termination, your right to use the Service will immediately cease.

Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Effect of Termination

Upon termination:

• Your access to the Service will be disabled
• We may delete your account and User Content
• Provisions of these Terms that by their nature should survive termination will survive (including ownership, warranty disclaimers, indemnification, and limitations of liability)

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

• Posting the updated Terms on the Service
• Updating the "Last Updated" date at the top of these Terms
• Sending you an email notification (for material changes)

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

14. General Provisions

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Innovations Beyond, Inc regarding the Service.
